The Home Office wrote on 14 October to confirm additional changes that will be implemented to the UK immigration system. Of most relevance to our clients:
- English language requirement for Skilled Worker visa applications will be increased to level B2 (currently the required standard is B1) – applicable from 8 January 2026. This will only apply to new Skilled Worker migrants – it will not be required for extension applications.
- Graduate visas will be granted for 18 months, instead of the current 2 year period – from January 2027.
- Immigration Skills Charge to increase by 32% - date not confirmed.
- Increased requirements for settlement (indefinite leave to remain), to potentially include the previously publicised time period rising from 5 years to 10 years – this is still subject to a consultation and no timeframe is published.
Sponsors should be aware that if they intend to sponsor new Skilled Worker applications prior to these changes taking effect, they should check to ensure that they have sufficient Certificates of Sponsorship available now. The Home Office anticipate a significant increase in demand, which in some circumstances may mean it is not possible to obtain the necessary Certificates to support a visa application prior to the deadline for the changes.
